A UK Spouse/Partner Visa allows an eligible person to live in the UK with their British or qualifying settled partner. The requirements differ slightly depending on whether you are applying from outside the UK or from within the UK.
Applying from outside the UK – Entry Clearance
You will normally need to show that:
• You and your partner are both aged 18 or over.
• Your UK partner is British, Irish, settled in the UK or otherwise has a qualifying immigration status.
• Your marriage, civil partnership or qualifying relationship is genuine and continuing.
• You both intend to live together permanently in the UK.
• You meet the applicable financial requirement. For most new applications, the minimum income requirement is currently £29,000 per year, although different rules apply in certain circumstances.
• You meet the required English-language requirement, unless exempt.
• You have suitable accommodation available in the UK.
• You provide the required supporting evidence, including passports, relationship evidence and financial documentation.
• A TB certificate may also be required when applying from certain countries.
Applying from inside the UK – Extension or Switching
If you are already living in the UK, you may be able to extend an existing Spouse/Partner Visa or switch from another eligible immigration category before your current permission expires.
You will generally need to demonstrate that your relationship remains genuine and continuing, that you intend to continue living together in the UK, and that you meet the applicable financial, English-language and accommodation requirements.
Importantly, not everyone who is physically present in the UK can switch to a Spouse Visa from within the country, so your existing immigration status and circumstances must be considered.
For people who first successfully applied under the partner route before 11 April 2024 and are extending with the same partner, transitional financial rules may apply. The income requirement can remain £18,600 plus the applicable amount for relevant dependent children, capped at £29,000.
